Personal Training Terms & Conditions

Introduction

Your agreement is with your personal trainer (the “Trainer”) who delivers your training.

These Terms and Conditions form part of your agreement with the Trainer. You understand that the Trainer is self-employed and you are entering into a contract with them alone.

Your instructions to commence personal training will constitute acceptance of these Terms and Conditions when you will become a client (a “Client” or “you”).

You are asked to pay special attention to the provisions related to cancellations.

Trainer’s Obligations

The Trainer will use their skills and knowledge to design a safe programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history.

The Trainer will provide the coaching, supervision, advice and support that you will need to achieve your goals.

You will decide at the time of sign up how many sessions per week you wish to undertake and how long those sessions will be.  Should you wish to make any changes to these sessions then two week’s notice is required in writing.  (See below for cancelation terms)

You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the sessions. In particular you acknowledge that individual results may vary and no particular result is guaranteed by your Trainer.

All Client information will be kept strictly private and confidential.

Your Obligations

It is understood between you and your Trainer that both must commit to your training programme 100% in order for you to achieve results.

You are required to arrive on time for each Session so that the Trainer’s full training plan is achieved on each visit.

You are required to wear appropriate clothing and footwear.

Your Trainer may require a letter of ‘medical clearance’ from your GP.

Please be aware that your GP may charge for providing this letter.

You understand and agree that it is your responsibility to inform the Trainer of any conditions or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.

If your Trainer requires further medical information from a practitioner, you must provide such details.

You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Trainer is not responsible, except where the injury was caused by his/her gross negligence or intentional act.

Your Trainer cannot be held liable in any way for undeclared or unknown medical conditions.

Cancellation and Refunds

BOOT CAMPS:

Cancellation Policy:  There is a 30 day cancellation policy in place.  This takes place from when we receive an email from you stating that you wish to cancel your payments.  Text message is not an acceptable form of cancellation.  This notice must be given via email.

Pausing payments:  Two week’s notice must be given should you wish to pause payments.  You can pause your payments for a maximum of 6 weeks per year, not including any time our sessions take a break over the Christmas and New Year Period.  This notice must be given via email.

Down grading sessions:  Two week’s notice must be given should you wish to drop down in sessions. This notice must be given via email.

Sessions are non-transferrable week to week:  For example if you pay for 3 sessions a week, and miss one, you cannot do 4 the next week to make up for it.

PERSONAL TRAINING:

Moving sessions/rescheduling sessions:  When you signed up there is a 24 hour cancellation policy in the sign up information.  We understand that events, meetings, kids etc can have an effect on this.  We like to be as flexible as possible but within reason.

If you have a session before 12pm the following day, you must let us know by 7pm that night should you wish to move/reschedule your session.  If you let us know before 7pm then we will move or make up the session.  Should you fail to let us know by this time then your session will be forfeited and you will still be required to pay for the session.

If you have a session after 12pm the following day, you must let us know by 6am the morning of your sessions should you wish to move/reschedule your session.  If you let us know before 6am then we will move or make up the session.  Should you fail to let us know by this time then your session will be forfeited and you will still be required to pay for the session.

Our trainers are busy and session times are locked in weeks in advance.  Late cancellations not only affect us they also affect clients whom we owe sessions to and could have made your time available to them.  Please also note we will do our best to fit in your make up sessions where we can, often this requires us to move other clients to do so.  Once a make-up session is booked in it cannot be re-scheduled.  Should you not be able to attend the make-up session then it will be forfeited.

Payments:  If for any reason you need to take time off for holidays/sickness/family reasons, refunds will not be given/payments are not paused.  Instead make up sessions will be held at an agreed time between both parties.  Please let me know as far in advance as you can so we can find time to make the sessions up.

SMALL GROUP TRAINING:

Cancellation Policy:  We like to have a maximum of 6 clients in the session but sometimes due to situations outside of our control there is more than this.  Should you not be able to make the Tuesday or Thursday 12pm session, you must let us know by 7pm the night before so we can advertise your time slot to another client/s.

Failure to do so will result in you having to pay for the session.  Cash is preferred for the session although bank transfer is also fine.  We can also set you up on DD if this is easier for you.

QUICK PAY:

Fees and Charges:  There is an 88c fee transaction charge on all Bank Direct Debit payments.  If you would like to pay via credit card then there is a 5% fee on top of your payments.

This is to cover fees Blueprint Health and Fitness is charged.  We make no money off of these fees.

Payments:  Payments come out on a Monday, Tuesday or Wednesday.  Should there be insufficient funds in your account then Quick Pay will charge you a $15 admin fee.  We do our best to get to this payment before they take it out but we cannot always do so.  Please make sure there are sufficient funds in your accounts when payment is due.

Once purchased, your Sessions are non-refundable and non-transferable.

Lateness Policy

If the client is late, the Session cannot be extended and will end at the appointed time.

If the Trainer is late, additional time will be added to the Session or to subsequent Sessions.

Health and Safety

Your trainer holds a current first aid certificate and the relevant qualifications required to train you.

Your Trainer has 5 million dollar Professional Indemnity Insurance and 10 million dollars Public Liability Insurance.

General

You understand that in the unlikely event of your Trainer being unable to continue your training, for any reason, you can request a full refund from your Trainer for any unfulfilled Sessions.

The Trainer has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. The Trainer will notify you of any change. When such a change(s) is made, if dissatisfied you can cancel this agreement once you have made any payments already due to the Trainer.

You are responsible for keeping all your contact information and marketing preferences up to date with the Trainer. In order to comply with the Data Protection Act 1988, the Trainer will only do what you ask him/her to do, or what you have given him/her permission to do with any personal or sensitive information held about you.

Your training may be filmed or pictures taken for marketing purposes. Your participation in a Session means you consent to photography, filming and sound recording which may include you as a Client and its use in commercial distribution without payment or copyright.

This agreement is governed by the laws of Australia and is subject to the jurisdiction of the Australian courts.
